Down payment assistance guidelines from HUD

There was some guidance provided by the Department of Housing and Urban Development (HUD) on October 25 with regard to downpayment assistance and the regulations regarding a mortgagor's cash investment.

  • Grants the AmeriDream Downpayment Assistance Program relief from the effective date of the rule until February 29, 2008
  • Nehemiah Corporation is granted relief from the effective date of the rule until April 1, 2008
  • All other similar downpayment assistance providers have not been granted relief from the rule, which is October 31, 2007
  • If the homebuyer has entered into a contract of sale on or before October 31, 2007 FHA will recognize the gift if properly documented as an acceptable source of the downpayment

Always, with all programs check with a knowledgeable lender who can assist with issues related to downpayment issues and the current HUD rules.

The Broken Window theory and Home Maintenance

Criminologists while studying urban crime have come up with a concept they call the "Broken Window" theory. Essentially as you walk the sidewalks around town and note broken windows your initial impession upon seeing it is that someone will replace the glass and fix it. Upon seeing the window remain broken day after day you conclude that nobody cares about this area and it is not the nicest part of town. Hence this leads to more damaged buildings, sanitation problems, and increased crime. The city of New York had a large problem with broken windows in the late 1980's and was one of the largest unsafe cities in the U.S. With focus on these broken windows and other areas of neglect, the city turned itself around in the 1990's and now is one of the safest large cities.

Likewise, we can extend this broken window idea to home maintenance. Deferred or neglected home maintenance by a homeowner may be acceptable while the homeowner lives in his own house. There may be valid reasons for it like financial, illness, can't find the right handyman, etc. Most of the time the reason is focus and discipline. That air conditioner unit needs replacing, this is the year we need the new roof, that trim needs painting, we really need to remodel these bathrooms, the carpet looks pretty worn, etc. But eventually you have to pay the piper.

A REALTOR in consultation with a seller in preparation for selling the home often delays the listing date to get the house in showing condition. This may take weeks and several thousands of dollars. Some sellers balk at getting the home in tip top shape and want to sell "as-is" but they are doing themselves a disservice if they go that route.

Paying attention to any "broken windows" along the way and maintaining your home is the best way to protect your investment.

Consistency is a theme to look for

When selecting a real estate agent to work with hopefully the professional you select will have some if not most of these consistent themes. If they do, you have something good working for you.

  • They discuss real estate and its various facets and complexities in terms you can understand
  • They add value to your purchase process or the selling stages that you couldn't have done without them
  • They offer you their opinion, from their experience and training
  • They make you and others always feel comfortable around them
  • They bring into focus the big picture, of how buying or selling a house meets your goals or solves your problem
  • They are very responsive, and take action as needed
  • They help you manage any risk associated with a purchase or sale
  • They take responsibility for their part in the transaction
  • As your agent with fiduciary representation, they are a partner to you
  • They are competent and negotiate for your benefit always

A "consistent performer" in real estate means more than just someone who sells a lot of houses in a year. That doesn't mean anything if they can't sell yours. Consistency is a theme of a set of behaviors that an excellent agent performs week in and week out as a duty to their client.
